§ 11-1. Unguarded excavations.

(a)

It shall be unlawful for any person to permit any well, cistern or other excavation to remain open, unguarded or uncovered, as to be a danger to others.

(b)

It shall be the duty of the code enforcement officer and the office of planning and development to enforce this section. The penalty fees shall be no less than fifty dollars ($50.00) and shall not exceed five hundred dollars ($500.00) for each offense.
